While the use of Real Estate Investment Trusts (REITs) has increased over the last 40 years, the recent Internal Revenue Service ruling allowing a telecommunications company to spin-off selected telecommunication assets and elect REIT status suggests an increased opportunity for REIT transactions as tax-efficient financing vehicles for fixed energy transmission or transportation asset investment, acquisition and development. Through the spin-off of these assets to a REIT, companies can streamline operations and possibly establish a more attractive financing structure.
