The Centers for Medicare and Medicaid Services (CMS) late on February 23, 2009, re-released the Draft CY 2010 Call Letter for the Medicare Advantage and Part D Programs (Programs). Comments on the Revised Call Letter are due to the agency on March 6, 2009.
The Revised Call Letter includes several new proposals and revisions to the original draft released on January 8, 2009. New proposals include a request for comments on whether CMS should limit the number of benefit designs (e.g., two plan benefit packages) that Medicare Advantage Organizations may offer in a given service area, and guidance indicating that “referral fees” paid to agents and brokers are akin to “finders fees” that are subject to the marketing regulations governing agent/broker compensation. The agency also retains its emphasis on increased compliance expectations and enforcement activity, including references to Medicare Advantage Organizations’ and Part D Plan Sponsors’ self-reporting their compliance with Program requirements and increased “secret shopper” activity.
