“Dawn Raids” in Airfreight Sector in Belgium
Even in a small country like Belgium, with a population of less than that of New York City, companies are not free from antitrust scrutiny. On 8 June 2010, the Belgian Competition Authority “dawn raided” several companies active in the airfreight sector in Belgium. It has been confirmed that Avia Partner and Flightcare Belgium were among these.
The companies under investigation are suspected of infringing rules regarding restrictive practices and/or abuse of dominant position, in particular concerning margin squeeze, cross-subsidisation and price fixing.
“Dawn raids” are carried out without prejudice to the presumption of innocence and no finding of antitrust infringement has been made so far. The Belgian Competition Authority will now have to consider the evidence collected and allow the companies involved to exercise their rights of defence before it comes to a final decision.
