DOL’s New Disability Claim Rules Add to a Plan Administrator’s Duties under ERISA Benefit Plans



Amy Gordon, Michael Graham, Susan Nash and Emily Rickard wrote this bylined article on proposed new Labor Department rules to strengthen current standards for adjudication of welfare and retirement plan disability claims. The new rules “will greatly increase the duties of plan administrators and fiduciaries in reviewing and rendering decisions on disability-related claims,” the authors wrote, because they “significantly add to the number of hoops that a plan administrator must reasonably and timely jump through to decide benefit claims.”
