Non-Compete Agreements: Friend or Foe?



Marc Sorini and Anne Harris wrote this bylined article discussing how craft distillers can use non-compete or non-solicitation agreements with key employees. The authors cautioned that even where such agreements are appropriate “it isn’t quite as simple as having an employee sign the agreement. The agreement must be enforceable … [since] restrictive covenants are governed by different laws in different states and agreements that are poorly drafted are likely to be found unenforceable.”
