Illinois Circuit Court Judge Dismisses 201 Qui Tam Sales Tax Cases


Mary Kay McCalla Martire, analyzing an Illinois judge’s dismissal (at the state’s request) of a False Claims Act lawsuit over sales tax collection, said that when the state intervenes to have a case filed on its behalf dismissed, the dismissal should be granted unless there is evidence of glaring bad faith by the state. « In every instance I’m aware of, here in Illinois, where the state has moved to dismiss one of these False Claim Act cases, it’s been granted, » Ms. Martire added.
