New York Tribunal Grants Sales Tax Refund for Securities Agency


Peter Faber represented a securities rating agency in a ruling granting a sales tax refund to the agency. A company that isn’t sure whether to collect sales taxes but pays the tax out of its own pocket can « get a refund of the taxes paid if the ultimate determination is that its services are not taxable, » as long as the company can prove that it didn’t charge customers for the tax, Faber said.
