Brian J. Boyle* advises clients on antitrust and consumer protection law. He has significant experience in complex litigation and investigations, merger control, compliance and government strategies.
Brian represents clients at the administrative agency, trial and appellate levels. His related experience includes consumer class actions, cartel matters, qui tam litigation, and other complex and cross-border litigation. Brian has represented clients in numerous antitrust or consumer protection investigations, including by the US Department of Justice (DOJ) Antitrust Division, Federal Trade Commission (FTC) and state attorneys general. He also has significant experience before legislative bodies, including representing executives providing committee testimony.
In addition to his disputes practice, Brian counsels clients on antitrust and consumer protection compliance and transactional matters. He has advised leading global businesses, executives and trade associations and has served as outside counsel to a high-level elected official and a state agency. His experience spans merger control, competitor collaboration, pricing and distribution strategies, data collection and sharing and other antitrust issues. Clients also turn to Brian for advice on consumer protection issues related to privacy, advertising, direct marketing, social media influencers, online reviews and labelling and disclosure requirements.
Brian is a frequent speaker on developments in antitrust and consumer protection law, and has written widely on the subject for publications including Law360. He serves on the advisory board of the American Bar Association YLD Antitrust Law Committee, and served as an editor of the forthcoming edition of the ABA’s Antitrust Law Developments treatise.
During law school, Brian served as editor-in-chief of the Villanova Law Review, and as an intern in the US Attorney’s Office, District of New Jersey.

- Represented a Fortune 500 company that was alleged to be the hub of multinational hub-and-spoke price-fixing conspiracy. Successfully resolved an extensive DOJ Antitrust Division investigation with no enforcement against the company or its employees*
- Represented a leading financial services company in multiple state and federal investigations, and related consumer class actions, alleging consumer protection violations related to advertising and direct marketing practices. Achieved favorable resolutions of all related matters*
- Represented an Asia-based global e-gaming company in an FTC investigation of potential violations of the Children’s Online Privacy Protection Act (COPPA). Resolved the investigation with no enforcement against the company or any employees*
- Uncovered through deposition testimony in a federal civil matter that the plaintiff had hid significant electronic evidence and made numerous misrepresentations to the court. Achieved a sanctions order striking claims for $100 million in alleged damages*
- Represented multiple Fortune 500 consumer products manufacturers in connection with the establishment of transactional data sharing protocols, and related agreements*
- Resolved multiple Telephone Consumer Protection Act (TCPA) class actions against a multinational services and technology company, and led an extensive audit and overall of the company’s privacy and communications compliance programs across multiple jurisdictions globally*
- Represented a leading global technology company in an antitrust dispute related to the licensing of standard essential patents. Achieved successful resolution without litigation*
