Amanda Enyeart maintains a general health industry and regulatory practice, focusing on fraud and abuse, information technology and digital health matters.
Amanda advises health care industry clients in all aspects of software licenses and other agreements for the acquisition electronic health record (EHR) systems and other mission critical health IT. Amanda’s health care IT transactional experience also includes advising clients with respect to software development, maintenance, service and outsourced hosting arrangements, including cloud-computing transactions.
Amanda has experience providing guidance on regulatory issues such as practitioner licensure (including nursing and dentistry), telehealth, Medicare and Medicaid reimbursement, compliance with the federal Stark Law and Anti-Kickback Statute and state fraud and abuse laws.
Amanda also counsels health care clients, including covered entities and business associates regarding compliance with the Health Insurance Portability and Accountability Act (HIPAA) and other federal and state privacy, security and breach notification laws. She has drafted comprehensive health information privacy and security compliance programs for health care providers and health care IT vendors, including those with cloud-based systems. She advises clients regarding their response to breaches of protected health information and has supported clients in subsequent investigations by the Department of Health and Human Services Office for Civil Rights and state regulators.
