Employment Cases to Watch in 2019


Rachel Cowen commented on a Ninth Circuit ruling in that employers cannot use a person’s prior salary to justify pay disparities. “I do think it’s making it harder for businesses to go out and simply pay whatever it takes to get a particular candidate and instead having to have a more focused and disciplined approach of saying, ‘This is what this job is worth, and this is what we’ll have to pay anybody that we recruit.’ And that’s a cultural shift.” The case, Yovino v. Rizo, is now being considered by the Supreme Court of the United States.
