McDermott Team Secures Major NLRB Victory for Dycora
A McDermott team secured a major victory before the National Labor Relations Board (NLRB) Division of Judges on behalf of client Dycora Transitional Health (Dycora). The Service Employees International Union (SEIU) alleged that Dycora engaged in unfair labor practices and objectionable conduct preceding a decertification election in May 2018.
Employees at the facility voted overwhelmingly against continued representation by the SEIU. The SEIU then filed unfair labor practices and objections to the election, which led to a three-day, consolidated trial before an administrative law judge in August 2018.
The judge dismissed all of the SEIU’s objections and affirmed the employees’ vote to decertify the SEIU.
