Same-Sex Marriage Ruling Raises Questions for Health Plans


Todd Solomon said that, in general, the Supreme Court’s endorsement of same-sex marriage rights means employers must now offer equal spousal benefits all employees if a separate insurance company funds the benefits. However, he added there is “technically no legal requirement” that self-insured employers do the same, which means that “we are going to see a lot of activity and a lot of litigation” if such employers deny same-sex spousal benefits.
