Supreme Court Weighs Merits of Reserve Programs


McDermott lawyers prepared a Supreme Court brief for SunMaid Growers, a marketing cooperative representing about 30 percent of the US raisin crop, supporting the Department of Agriculture’s marketing order reserve program. The brief contended that raisin growers opposing the program “acted as free riders in defying the marketing order’s reserve-pool requirements, and thereby gained a competitive advantage as both handlers and as producers.” Read the full article
