  • Advising a high net worth individual on a multi-million pound professional negligence claim against his legal advisors following the acquisition of an indirect interest in residential property resulting in significant personal tax liability*
  • Advising an international company on a dispute between a high net worth family and their financial advisors in respect of the decision making investment strategy and the use of bank loans for family investment leading to an over-funded trust triggering a significant tax liability*
  • Advising on available relief from a professional trustee’s erroneous decision-making and breach of fiduciary duty. This involved making new law in Guernsey by winning a Hastings-Bass application in the Guernsey Court of Appeal. In this case the trustees had failed to take legal advice in respect of the tax consequences of a proposed transaction of a high net worth individual’s QROPs and the beneficiary’s legal team had failed to identify the appropriate tax consequences*
  • Advising on the interpretation of trust documents and powers in respect of indexation rules. Advising on the contentious elements of a multi-employer scheme to determine whether the trustees of the scheme have the power to select the inflation index by reference to which indexation and revaluation would be calculated*
