Kristin E. Michaels focuses her practice on all aspects of labor and employment litigation and counseling. Her practice is national in scope and her clients include employers from a wide range of industries, including hospitality, media, manufacturing, telecommunications, retail, steel, health care, automotive, cable and utilities.
Kristin has litigated numerous cases from inception through trial before federal and state trial courts, courts of appeal, the National Labor Relations Board, the Department of Labor, and arbitration tribunals throughout the United States. These cases have involved a full spectrum of labor and employment issues arising under Title VII of the Civil Rights Act, the National Labor Relations Act, the Age Discrimination in Employment Act, the Americans With Disabilities Act, the Fair Labor Standards Act, Section 301 of the Labor Management Relations Act, and various other federal and state statutes, as well as contractual issues and terminations under collective bargaining agreements. Kristin has served as the chief spokesperson on behalf of companies in numerous labor negotiations around the country.
In the counseling arena, Kristin routinely advises and trains companies on all forms of employment corporate compliance and conducts internal employment investigations and audits. She also advises companies and boards of directors on executive retention and separation, and the full spectrum of labor and employment issues involved in sales, acquisitions and other forms of corporation transactions.
Served as lead counsel in three class action employment lawsuits involving a national media company. Obtained a successful ruling by the US Court of Appeals for the Eighth Circuit on threshold issues, resulting in plaintiffs’ agreement to dismiss the cases on company-favorable terms
Representing a nationwide staffing company in Equal Employment Opportunity Commission (EEOC)-initiated litigation; after alleging that the company discriminated against a class of minority applicants, the EEOC dropped those allegations and is seeking a nominal settlement
Served as lead counsel on behalf of a manufacturing company and secured a defense verdict against allegations of discrimination and sexual harassment
