Daniel Melvin said a large anti-kickback law violation penalty against a South Carolina hospital “underscores the very unfortunate situation that the hospital industry is in under the Stark Law.” By ignoring the advice of one attorney out of four who questioned its employment agreements, the hospital must suffer the “catastrophic” consequences of litigation, Mr. Melvin continued, adding that many hospitals in similar situations choose to settle claims rather than fight them.
