5 Decisions That Paved the Way for the Clean Power Plan


Jacob Hollinger discussed Massachusetts v. EPA case, the 2007 Supreme Court decision which held that the EPA can regulate greenhouse gasses. Noting that the Court has shown little appetite for revisiting the landmark ruling, Mr. Hollinger said, “It’s pretty clear that EPA has the authority to regulate greenhouse gases. But the issue is, does EPA have that authority under this particular provision” to create the Clean Power Plan now being litigated before the Court.
