Marc Brown explained that, to avoid patent prosecution mistakes, “the claim language in the patent claims should be clear and crisp. Cases are often lost because there is so much mush in the claims.” Mr. Brown noted that unclear claim language can be a “serious problem” in patent litigation because “many patent infringement cases turn on what the language in a patent claim means. While attorneys can’t completely eliminate that fight, they can certainly reduce the chances of wild interpretations by using clear and unambiguous language.”
