Cases are often lost because there is so much mush in the claims.” Mr. Brown noted that unclear claim language can be a “serious problem” in patent litigation because “many patent infringement cases turn on what the language in a patent claim means. While attorneys can’t completely eliminate that fight, they can certainly reduce the chances of wild interpretations by using clear and unambiguous language.”
