Richard Pearl commented on what employers should do as the US Supreme Court considers hearing an Employee Retirement Income Security Act case on cross-plan offsetting. “We want to look at all of the contracts and all the agreements that you have with the third-party administrators and the networks, and to the extent you can get additional information about agreements with providers, we want to see those too,” Pearl said. “Because we want to see how the money flows. We want to see if the TPA overpays a claim, who ultimately is going to be responsible.”
