Melissa Nott Davis urged that evidence at patent trials focus on a theme, explaining that “the evidence has to wrap onto the story you’re telling. When you’re thinking about evidence for trial, you have to be incredibly disciplined with yourself and your team to pick the hot documents and stay with them,” Ms. Davis continued. “Once you realize you have identified the documents that are going to matter, you have to be willing to let go of other documents. If you keep the world too broad, you will be throwing too much at the jury.”
