Wilbur Boies, who successfully defended an investment firm in the Sixth Circuit against employee claims of fiduciary duty violation over the investments in their pension plan, said that the Court “got it right by looking at the fiduciary process of [the firm] and by conducting an efficient-market-price analysis.” Mr. Boies added that the employee claims were “built on second-guessing about price movements.”
