Guy Collier said, in the wake of a three-judge DC Circuit panel’s ruling that only those seeking health coverage via exchanges “established by the State” are eligible for subsidies, that “it’s inevitable” the case “will go up to the full circuit.” Should that happen, Mr. Collier, who helped public health professors file an amicus brief supporting the government’s position, predicted that it will “be a much tougher case for the appellants” who opposed the subsidies.
