Raymond Jacobsen, counsel to Constellation Brands, said that the judge broadly agreed with the defendants that there was nothing wrong with price increases if done unilaterally. The US Department of Justice’s antitrust division blessed the $20 billion deal in June 2013 after the brewers agreed to hand over a major brewery and the rights to its popular Corona and Modelo beers to Constellation Brands. The plaintiffs continued to challenge the deal under section 7 of the Clayton Act, but the court dismissed charges in October for failing to state a claim.
