Alioto Turns to Ninth Circuit After Judge Downs Beer Challenge Again

The US Department of Justice’s antitrust division blessed the $20 billion deal in June 2013 after the brewers agreed to hand over a major brewery and the rights to its popular Corona and Modelo beers to Constellation Brands. The plaintiffs continued to challenge the deal under section 7 of the Clayton Act, but the court dismissed charges in October for failing to state a claim.
