Appellate Ruling Sharpens Scrutiny of LGBT Employees’ Benefits

Todd Solomon said the Seventh Circuit’s Hively decision means employers within that Circuit which do not provide equal benefits to LGBT employees and spouses are at risk of a Title VII discrimination lawsuit alleging sex discrimination. “These claims can be costly to defend,” Mr. Solomon noted, adding that “most companies offer parity in workplace benefits for LGBT employees [and] do not differentiate between types of spouses.”
