Eugene Goldman praised as “refreshing” the SEC’s openness to changing its administrative rules, and suggested a change to let respondents take their own depositions and cross-examine witnesses before a trial begins. “Serious consideration should be given to affording respondents the right to depose key witnesses in advance of the hearing, instead of just confronting them for the first time years after they testified, perhaps inaccurately, during the investigation,” Mr. Goldman said.
