Stefan Meisner, who with Paul Devinsky represented a major table saw manufacturer that was among a number of such companies facing an antitrust lawsuit, said he and the client were “pretty happy” that a Virginia federal judge dismissed the case with prejudice. Mr. Devinsky added that the decision to dismiss with prejudice likely was made because the plaintiff failed to oppose the defendants’ first motions to dismiss, opting instead to file an amended complaint. The judge therefore may have reasoned that the “plaintiff’ had already had a “second bite at the apple,” Mr. Devinsky said.
