Catherine Battin said she was not aware of state enforcement initiatives attempting to tax trade show participants but noted that state revenue department questionnaires about trade show activity could trigger audits. “A lot of times they will send these [questionnaires] out as a fishing expedition. If you mark ‘yes’ to any of their 50 questions, they will hit you up,” she explained, adding that there is very little case law to guide taxpayers.
