McDermott Secures Voluntary Dismissal of Claims Against Bewell Connect

McDermott Will & Emery successfully secured a voluntary dismissal of a patent infringement lawsuit brought by patent assertion entity Encoditech against Bewell Connect (part of the Visiomed Group).

In September 2018, Encoditech filed suit in the US District Court for the District of Delaware, asserting a Bewell Connect product infringes a patent owned by Encoditech.

Over a two-month period, the McDermott team engaged in negotiations with Encoditech’s counsel, which culminated in an agreement by Encoditech to dismiss its claims with prejudice and without any payment or other valuable consideration from Bewell Connect.

The cross-practice McDermott team included IP partners Paul Schoenhard and Nicole Jantzi, Litigation associate Sarah Hogarth, and Health partners Stephen Bernstein and Sarah Hogan.

The case is Encoditech LLC v. Bewell Connect Corp., No. 1:18-cv-01474-RGA (D. Del.).
