Catherine Battin said an Illinois class action claiming that major retailers failed to properly deduct manufacturer’s coupons when calculating sales tax creates a problem where “retailers are seemingly damned if they do and damned if they don’t. Retailers typically use their best efforts to comply with the law and do what is right. Yet they still face class actions” over tax calculation. Matthew Boch agreed that the plaintiffs are taking “a very technical reading of the regulation,” adding that “this seems like something the [state revenue] department would have previously caught if there had been an issue.”
