CMS Delays Final 60-Day Overpayment Rule for a Year, Aims for ‘Clear Requirements’


Tony Maida said the fact that “there are a lot of different issues to try to unpack” helps explain the delay in finalizing the proposed rule for refunding Medicare and Medicaid overpayments within 60 days. Mr. Maida, who worked on the rule when at the HHS Office of Inspector General, noted that “when the 60-day clock starts to tick, you want to strike the right balance between having enough time to make an informed decision about whether there is an overpayment and not enabling the ostrich defense of sticking your head in the sand to avoid having to make that decision.”
