Coal Set for SCOTUS Showdown


Jacob Hollinger assessed an upcoming Supreme Court case on the Obama Administration’s stringent anti-pollution controls for coal-burning power plants. Given that it focuses on the single issue of when the EPA should have considered the high costs of the controls, Mr. Hollinger said that “the case is unusual in that it turns on the meaning of a single word in a single paragraph of a 300-plus page statute, and it is a paragraph that applies to just one industry.”
