Mark Pearlstein and Laura McLane were the authors of an Independence Institute working paper on misuse of the False Claims Act (FCA), cited in this article. Their paper showed that the government’s aggressive FCA use in health care reimbursement cases will harm patients as it allows second-guessing of physician decisions, raises costs by encouraging meritless whistle-blowing and cuts care access as risk-averse providers bow out.
