Michelle Strowhiro commented on states limiting restrictive covenants and the alternative ways employers are protecting trade secrets, including the Defend Trade Secrets Act and the Computer Fraud and Abuse Act. “I think the climate not just in California, which is always a tough place to be with restrictive covenants, but in a lot of states has been moving towards advancing [employee] mobility,” she said. “So I think the focus is moving swiftly towards creative ways to enforce those rights outside of non-competes and non-solicitation agreements.”
