Timothy Walsh said that the cross-border bankruptcy trial on dividing Nortel’s assets in liquidation is “cutting-edge” and demands “a massive amount of cooperation” among attorneys for all the parties. “It requires a lot of the attorneys to be mindful of the cost of litigating similar issues in different jurisdictions,” Mr. Walsh continued, but he added that the expense is small compared to what it would have cost to hold separate trials in Canada and the US. “If you think about the potential savings of not [having to run two different trials], then the cost becomes de minimis,” he noted.
