D.C. Circuit Upholds Downward Adjustment To Rate for Rural, Sole Community Hospitals

M. Miller Baker argued the case for the appellants as the U.S. Court of Appeals for the D.C. Circuit Jan. 27 affirmed a district court’s decision that the secretary of health and human services acted reasonably in making a downward adjustment to the rate paid to rural and sole community hospitals to ameliorate the increasing rate paid to all hospitals due to the revamping of the diagnosis coding system. Also on the briefs were Ankur J. Goel and John H. Walker.
