Delaware Unclaimed Property Audit Procedures ‘Shock the Conscience,’ Federal Court Says

Diann Smith, speaking on a federal court decision in which the judge questioned Delaware’s use of extrapolation in making tax assessments, said it brings up the question whether other states that are not the state of domicile, which have not been as aggressive in audits, or have not carried through on applying estimation techniques, will take this case as validation of the estimation techniques.
