Jon Dubrow said that a discount retailer was “pretty aggressive to be going public” with its prediction that the FTC would soon approve its planned acquisition of a competitor. Mr. Dubrow, who has handled similar transactions before U.S. competition regulators, added that even if the companies “are fairly far along with FTC staff and have a good comfort level that they will be able to get this closed,” to secure approval “you’ve got to make the FTC — an independent agency — move along with you on the timetable you would like to happen, and you can’t always make that so.”
