M. Miller Baker and Charles Quigg successfully represented the Pharmaceutical Care Management Association for an Eighth Circuit judgment which held that Iowa’s law regulating certain actions by prescription drug benefit managers is preempted by federal ERISA rules. Mr. Baker said the client was “delighted” with the Eighth Circuit ruling, which he hoped “will discourage other states from similarly attempting to impermissibly regulate the PBM function of health benefit plans protected by ERISA.”
