Joseph Urwitz said that, if the Supreme Court had not ruled faith-based hospital pension plans were exempt from ERISA, “health systems would’ve been in for a world of hurt. This is unequivocally positive for health systems.” However, he added, since these plans are exempt from ERISA, they are now also exempt from ERISA’s provisions pre-empting state laws, so plan sponsors may be exposed to claims made under state law.
