French Constitutional Court Kills Controversial Competition Powers

Lionel Lesur said that the French Constitutional Council decision to strike down the competition authority’s forced divestiture law involved only the procedure for the authority to seek records, without commenting on whether the powers would be unconstitutional in principle. ”One may think that the government might be able to build a new scheme in order to reach this goal,” Mr. Lesur said, by convincing the council to clear an amended process with more procedural rights guarantees.
