Arthur Rosen, commenting on whether the Supreme Court will follow Justice Kennedy’s lead in questioning the Quill tax nexus decision by taking the Direct Marketing Association’s appeal of a Colorado nexus law, suggested that Kennedy might “persuade at least some of the seven remaining Justices to see the world his way; on the other hand, perhaps the Court will live by what it said in Quill, that this is a matter for which Congress is much better suited to address.”
