Tony Maida predicted that the US Department of Justice would resist efforts to totally eliminate the Stark Law, but added that policymakers might act on the law’s complex exceptions “to make them less complicated.” Mr. Maida added that, given new HHS Secretary Price’s longtime criticism of HHS regulations, “Congress may take some action on legislation, but if HHS takes a different view of the Stark Law, [the department] could make some regulatory changes to lessen its burden.”
