Caroline Ngo said that the US Department of Treasury’s proposed regulations for repatriating offshore earnings answered the question of whether previously taxed income could be distributed tax-free by foreign companies with a foreign deficit company in the chain. The IRS is giving companies an option to make an election that would make such distributions tax free in certain circumstances, she said.
