Edward Zacharias and David Gacioch have heard from HHS officials about a new era of HIPAA privacy enforcement that Mr. Gacioch said is “going to likely keep building on itself.” Mr. Zacharias said that since providers have had a decade to “really understand what the rules require” for privacy, the “era of being more lenient” is ending for enforcement. Mr. Gacioch noted that stricter privacy and security breach reporting rules “opens up the potential for further regulatory action and the potential for liability that wouldn’t otherwise be there.”
