Stephen Ryan said he did not see much legal precedent for finding that a former IRS official waived her Fifth Amendment rights by briefly denying any wrongdoing to a House committee that now seeks to hold her in contempt. “I don’t think the court would find there’s been a waiver, based on a couple of sentences at the beginning of the hearing,” he noted. Mr. Ryan added that another House committee’s effort to criminally prosecute the same official will proceed on a separate track from any contempt case, with the two actions being “only related on the subject matter.”
