Peter Faber, who wrote an American College of Tax Counsel amicus brief urging Supreme Court review of a Washington State retroactive tax, said the Court’s refusal to review would “embolden” state revenue departments and legislatures. Mr. Faber’s brief had called on the high court to correct such state conduct in light of its 1994 US v. Carlton decision. Instead, Mr. Faber added, the court left the retroactivity door wide open.
