Mary Kay McCalla Martire, analyzing an Illinois judge’s dismissal (at the state’s request) of a False Claims Act lawsuit over sales tax collection, said that when the state intervenes to have a case filed on its behalf dismissed, the dismissal should be granted unless there is evidence of glaring bad faith by the state. “In every instance I’m aware of, here in Illinois, where the state has moved to dismiss one of these False Claim Act cases, it’s been granted,” Ms. Martire added.
