Stephen Kranz said that if the Kentucky legislature had wanted to tax streaming video services, “it could have done so when it adopted their tax on specified digital products starting in 2010.” Because this was not done, Mr. Kranz said he was not surprised that the Kentucky Board of Tax Appeals rejected the Department of Revenue’s attempt to tax the services.
