Jacob Hollinger said that, if the Supreme Court decides in a new case to reject the EPA’s ability to include greenhouse gas restrictions into the large facility permitting process, “It’s going to create some ambiguity about EPA’s authority … Once these decisions are entered, … they take on a life of their own” with regard to future agency actions. Noting confusion about climate change and environmental regulation in the questions of some justices, Mr. Hollinger added, “I would say it’s really impossible to predict what’s going to happen …The questions illustrate the complexity of the Clean Air Act.” Read the full article
