Overview
PARIS (March 31, 2017) – International law firm McDermott Will & Emery successfully represented Corsica Ferries, a private French-Italian maritime sailing company, in relation to maritime service to Corsica.
This case gave rise to an important and unprecedented decision by the Administrative Tribunal of Bastia on free and undistorted competition based on the state aid the Territorial Collectivity of Corsica paid to SNCM between 2007 and 2013, which was considered illegal and incompatible with the law of the European Union by the domestic and European courts.
In this context and in support of Corsica Ferries’ request, the Administrative Tribunal of Bastia ordered the Territorial Collectivity of Corsica to pay almost 85 million euros in damages to Corsica Ferries in the judgment of February 23, 2017. These damages are to compensate the harm Corsica Ferries suffered from the illegal competition of the two SNCM ships that were financed by illegal state aid and operated as a public service delegation contract.
